Before any steps can be taken to incorporate a Company, the name by which the Company is proposed to be incorporated must be chosen and the approval of the ROC (SSM) for the use oft he name be obtained. The ROC has the discretion to reject a proposed name which in his opinion (Section 22(1):

- is undesirable; or
- is a name similar to the name of another existing Company
- a name which has been reserved
- is a name that the Ministry of Domestic Trade and Consumer Affair has directed th ROC not to accept for incorporation.
The words ie...King, Sultan, Federation, ASEAN, Bank, Crown etc will not accepted by ROC unless consent from Minister is obtained. Also the words that are misleadng as to the indentity, nature, objects or purpose and also that are blasphemous or likely to be offensive to members of the public.
